The StarBar is committed to protecting your privacy and accordingly, we have developed this privacy policy (“Policy”). We will only use the information that we collect about you lawfully (in accordance with the Electronic Communications and Transactions Act 2002, the Consumer Protection Act, 2008, and other applicable data protection laws enacted in South Africa from time to time).

By accessing or using our Website, you acknowledge that you have read all of the terms of this Policy and our Website’s Terms and Conditions, and that you understand, and agree to be bound by, all the provisions in this Policy and the Terms and Conditions. If you do not agree to be bound by these terms, please exit this page and do not access or use the Website.
Our Policy explains what information we collect on the Website, how we use and/or share this information, and how such information is maintained. This Policy only applies with respect to the information collected on the Website and not with respect to any information collected or obtained through other methods or sources.
Our Policy ensures that any information you provide us remains private and secure
We will never collect sensitive information about you without your consent.

Personally Identifiable Information
We collect personally identifiable information that is volunteered during the Registration process or in response to specific information requests explicitly presented to you.

We may also collect your Internet Protocol (“IP”) address to help diagnose problems with our server, and to administer this Website. An IP address is a number that is assigned to your computer when you use the Internet. Your IP address is also used to help identify you during a particular session and to gather broad demographic data.
We may ask for your e-mail address during your use of the Website. Also, to purchase Vouchers you may be requested to provide any or all of the following personal identifiable information: first and last name, postal address, e-mail address, date of birth, telephone number and details of a payment mechanism, such as credit card details.

Use and Sharing of personal identifiable information
All personal identifiable information is retained by The StarBar, in confidence and in accordance with applicable data protection laws in South Africa.
We use personal identifiable information to provide you with information about The StarBar, to properly provide you with the Service and for marketing ourselves to you.
In general, we may use the personal identifiable information we have collected to:

  • manage your account and provide you with customer support;
  • conduct market research, and analyse your use of our Service;
  • communicate with you;
  • negotiate deals tailored to your specific location and interests; and
  • enforce our Terms and Conditions.

Any financial or payment information, such as credit card details, provided to us for the purposes of concluding a transaction on our Website, will be used by us to process your payment for any voucher. This information may also be used to identify, and to protect you and us against, possible fraudulent transactions, and to generally manage our business.

We will never sell or rent your personal identifiable information to anyone else for their marketing purposes without your consent.
However, we may pass your personal identifiable information to our agents and subcontractors to help us with any of our uses of your data set out in this Policy. For example, we may use third parties to provide us with marketing or customer service assistance or send it to a credit card provider to process a payment.

We also always reserve the right to disclose personal identifiable information in order to:
(a)       comply with applicable laws;
(b)       respond to governmental enquiries (or enquiries from a legal, governmental or quasi-governmental or local authority agency or Internet protection agency of any type);
(c)       comply with a valid legal process or procedure; or
(d)       protect our rights or property, this Website, and/or other users of this Website; or
(e)       fulfil any contractual obligations we may have in relation to your use of the Service.

Please note that as part of any personal identifiable information sharing which we list above, we may send your information internationally. Different countries offer varying levels of protection of personal information. By submitting personal identifiable information to us, you acknowledge that provided we have used your data in the ways set out in this Policy, we cannot be held responsible for any use of your data by third parties who receive and process your data. We undertake to make every effort to ensure that your personal identifiable information is processed only for the purpose set out above, and for no other purpose.

We use “cookies”, a name for a specific technology used to register user preferences associated with the use of a particular website. A lot of websites do this, because cookies allow the website publisher to do useful things like find out whether the computer (and probably its user) has visited the site before. The information stored in the cookie is used to identify you and enables us to track the pattern of behaviour of visitors to the Website so that we can provide a more efficient and personalised service.   • after Registration, notifying you of your account details;
  • as reminder emails about the services we offer (particularly if you have not used them yet or not used them for a while);
  • to send you information or Vouchers which you have asked for;
  • as a newsletter;
  • as promotional emails; and
  • to offer related services to you from the StarBar.

However, in terms of any marketing or promotional emails we may send, we will always give you the chance to opt-out (or unsubscribe) from them in the future.

Security and retention
We have put in place a number of measures to ensure that your personal identifiable information is secure.  However, anyone who may have access to your The StarBar account will also be able to access your personal identifiable information. Accordingly, we recommend that you do not share your password with anyone.
The personal identifiable information which we hold will be held securely within our systems in accordance with our internal security policy and the law.
Unfortunately, transmitting data over the internet cannot be warranted to be 100% secure. Whilst we take all reasonable precautions to safeguard this information, we may be unable to prevent unauthorised access to such information by third parties or inadvertent disclosure of such information during transit and we are not responsible for any actions taken by such third parties. You acknowledge this risk when communicating with and transacting on the Website.

Transfer in Certain Circumstances
If there is a sale, merger, consolidation, change in control, transfer of substantial assets, reorganisation or liquidation of the StarBar or any of its subsidiaries, then, in our sole discretion, we may transfer, sell or assign information collected on and through this Website (including, without limitation, personal identifiable information and other information), to one or more relevant third parties.

Non personal information
In order to constantly improve the Service, we may use certain non-personal or depersonalised information that may be collected from time to time through your use of the Website or from other sources, to develop targeted advertising on our Website and on websites of third parties. This information may also be shared with third parties, including advisors, advertisers, suppliers and investors, for the purposes of improving the Service, and analysing the business.

Changes to this Policy
Please note that this Policy forms part of the Terms & Conditions for use of this Website and forms part of the Agreement between you and us. We review this Policy from time to time, to ensure that it reflects how we use your information, and accordingly we may, from time to time, amend this Policy, in whole or part, in our sole discretion. Any changes to this Policy will be effective immediately upon the posting of the revised policy on the Website.
In the event of any material change to this Policy, we will announce the change either: (a) on the home page of the Website, or (b) by email, if we have your email address. However, in any event, by continuing to use the Website following any changes, you will be deemed to have agreed to such changes. Browsing StarBar
You can watch videos on StarBar without having a StarBar or a StarBar Account.

Your StarBar Account
For some activities on StarBar, like uploading videos, posting comments, flagging videos, or watching restricted videos, you need a StarBar or StarBar Account. We ask for some personal information when you create an account, including your email address and a password, which is used to protect your account from unauthorized access. A StarBar Account, additionally, allows you to access other StarBar services that require registration.

Usage Information
When you use StarBar, we may record information about your usage of the site, such as the channels, groups and favourites you subscribe to, which other users you communicate with, the videos you watch, the frequency and size of data transfers, and information you display about yourself as well as information you click on in StarBar (including UI elements, settings). If you are logged in, we may associate that information with your StarBar Account. In order to ensure the quality of our service to you, we may place a tag (also called a “web beacon”) in HTML-based customer support emails or other communications with you in order to confirm delivery.

Content Uploaded to Site
Any personal information or video content that you voluntarily disclose online (e.g., video comments, your profile page) may be collected and used by others. If you download the StarBar Uploader, your copy includes a unique application number. This number, and information about your installation of the Uploader (version number, language) will be sent to StarBar when the Uploader automatically checks for updates and will be used to update your version of the Uploader.

If you submit personal information to StarBar, we may use that information to operate, maintain, and improve the features and functionality of StarBar, and to process any flagging activity or other communication you send to us.
We do not use your email address or other personal information to send commercial or marketing messages without your consent. We may use your email address without further consent for non-marketing or administrative purposes (such as notifying you of major StarBar changes or for customer service purposes). You also can choose how often StarBar sends you email updates in your StarBar Account settings page.

We use cookies, web beacons, and log file information to:
(a)          store information so that you will not have to re-enter it during your visit or the next time you visit StarBar;
(b)          provide custom, personalized content and information;
(c)          monitor the effectiveness of our marketing campaigns;
(d)          monitor aggregate metrics such as total number of visitors and pages viewed; and
(e)       track your entries, submissions, and status in promotions, sweepstakes, and contests.

Information that is Publicly Available
When you create a StarBar Account, some information about your StarBar Account and your account activity will be provided to other users of StarBar. This may include the date you opened your StarBar Account, the date you last logged into your StarBar Account, your age (if you choose to make it public), the country and the number of videos you have watched.
Your StarBar Account name, not your email address, is displayed to other users when you engage in certain activities on StarBar, such as when you upload videos or send messages through StarBar. Other users can contact you by leaving a message or comment on the site.

Any videos that you submit to StarBar may be redistributed through the internet and other media channels, and may be viewed by other StarBar users or the general public.
You may also choose to add personal information which may include your name, gender, profile picture or other details, that will be visible to other users on your StarBar Account channel page. If you choose to add certain features to your StarBar Account channel page, then these features and your activity associated with these features will be displayed to other users and may be aggregated and shared with your friends or other users. Such shared activity may include your favorite videos, videos you rated and videos that you have uploaded.

Your Choices
If you have a StarBar Account, you may update or correct your personal profile information, email preferences and privacy settings at any time by visiting your account profile page.
You may control the information that is available to other users and your confirmed friends at any time by editing your StarBar Account and the features that are included on your channel page. If you have enabled Active Sharing, other users may see that you, as identified by your account name, not your email address, are watching the same video.

Advertising on StarBar
StarBar strives to provide you with relevant and useful advertising and we use the DoubleClick cookie, as well as other third party ad serving systems, to do so. We may use a range of information including cookies, web beacons, IP addresses, usage data and other non-personal information about your computer or device (such as browser type and operating system) to provide you with relevant advertising. While you are logged in or logged out of your StarBar Account, we may also show you advertising based on non-personally identifiable information you have provided to us in your StarBar Account.

We use the DoubleClick cookie on StarBar to help advertisers and publishers serve and manage ads on this site and other StarBar partner websites. Advertisers may serve ads based on interests and demographic categories associated with non-personally identifiable online activity, such as videos viewed, frequency of uploading or activity on other partner sites. Advertisers may also serve ads to you based on previous activity on that advertiser’s website or based on non-personally identifiable information from other companies. This non-personally identifiable information is held separately from your StarBar Account data, or other personally identifying information in our possession.

You may view, edit and add to the categories used to provide you with interest-based advertising in the Ads Preferences Manager for the DoubleClick cookie. Your ads preferences will be respected across StarBar, partner sites and StarBar sites using the DoubleClick cookie to serve such ads. Other third-party ad serving companies may display ads on StarBar, provided they comply with our ad serving requirements. StarBar does not provide any personal information to these third-party ad servers or ad networks without your consent. You should consult the respective privacy policies of these third-party ad servers or ad networks for more information on their practices and for instructions on how to opt-out of certain practices. StarBar’s privacy policy does not apply to, and we cannot control the activities of, such other advertisers or web sites. Any data obtained by third-party ad servers subsequently shared with StarBar is maintained and dealt with by StarBar in accordance with this privacy policy.

Information sharing
StarBar only shares personal information with other companies or individuals outside of StarBar in the following limited circumstances:

  • We have your consent. We require opt-in consent for the sharing of any sensitive personal information.
  • We provide such information to our subsidiaries, affiliated companies or other trusted businesses or persons for the purpose of processing personal information on our behalf. We require that these parties agree to process such information based on our instructions and in compliance with this Privacy Policy and any other appropriate confidentiality and security measures.
  • We have a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to (a) satisfy any applicable law, regulation, legal process or enforceable governmental request, (b) enforce applicable Terms of Service, including investigation of potential violations thereof, (c) detect, prevent, or otherwise address fraud, security or technical issues, or (d) protect against harm to the rights, property or safety of StarBar, its users or the public as required or permitted by law.

Information security
We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. These include internal reviews of our data collection, storage and processing practices and security measures, including appropriate encryption and physical security measures to guard against unauthorized access to systems where we store personal data.

We restrict access to personal information to StarBar employees, contractors and agents who need to know that information in order to process it on our behalf. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations

Accessing and updating personal information
When you use StarBar services, we make good faith efforts to provide you with access to your personal information and either to correct this data if it is inaccurate or to delete such data at your request if it is not otherwise required to be retained by law or for legitimate business purposes. We ask individual users to identify themselves and the information requested to be accessed, corrected or removed before processing such requests, and we may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, or would be extremely impractical (for instance, requests concerning information residing on backup tapes), or for which access is not otherwise required. In any case where we provide information access and correction, we perform this service free of charge, except if doing so would require a disproportionate effort. Because of the way we maintain certain services, after you delete your information, residual copies may take a period of time before they are deleted from our active servers and may remain in our backup systems.
